For the purpose of these Terms & Conditions of Use, wherever the context so requires "You" or "User" shall mean any natural or legal person who has agreed to become a User/ Service Seeker of the Website and SERVICE PROVIDER, who lists his/her services as a SERVICE PROVIDER on the Website by providing Registration Data. The term "We", "Us", "Our" “Germa” “Germa Bazar” shall mean Germa Bazar L.L.P.

By using the Services, you represent and warrant that: (a) all registration information you submit is truthful and accurate; (b) you will maintain the accuracy of such information; (c) you are Eighteen (18) years of age or older upon registration; and (d) your use of the Services does not violate any applicable Indian law or regulation, or any other obligation (including contractual obligation) you might have towards third parties. Any Account you have created by registering on the Germa Bazar Service Provider Site may be deleted without warning if we believe that any representation and warranty you make hereunder is breached or inaccurate.  

Germa Bazar acts as a platform allowing our service providers/users who comply with our Terms to provide and use the services listed on this Platform.

Germa Bazar are engaged in the business facilitating connections between the user/ customers who seek specific services and service professionals that offer the services.  

The Website is made available for use by a person or organisations for listing their services and also by a person or organisations who wants to avail relevant services.

Fees and Payment

 

The use of the Website/App and Services is free of cost as Germa Bazar is just a platform displaying the contact details/ information of the service providers to the customers. Germa Bazar does not charge any fees or commissions to either the Service Providers or Customers who utilize the services listed in the Germa Bazar Service Portal.

 

However, this no charge policy can be amended at our discretion and we reserve the right to charge for any of the Services.

 

The USER can pay the service fee and any other charges directly to the provider of services on completion of services and both the provider and the user doing so at their own discretion, without GERMA being involved.

 

Germa Bazar will not be responsible for any loss or damage to you due to your use of the Payment Facility on the Website/App of the Service Provider/s. Germa will not be held responsible for any disputes/ conflicts arising between the user/s and Service provider/s in this context.

 

Germa Bazar will not be liable for damages of any kind incurred to any parties as a result of the information contained on this Platform. Users shall not use or manipulate this service for any fraudulent activity or purpose. Items or services offered for sale must comply with applicable laws.

 

You hereby agree that the use of the Website/App and the services shall be at your sole risk.

 

Germa Bazar makes no warranty regarding the quality of any products, services, accuracy, timeliness, truthfulness, completeness or information purchased or obtained through the sites, content or services.

 

Germa Bazar shall not be liable for any direct, indirect, incidental, special, consequential damages for loss of profits, goodwill, use, data, or other intangible losses resulting from the use or the inability to use our services.

 

Service Providers and Service Seekers (user) hereby agree and acknowledge that:

 

Germa Bazar shall not be liable for user content or the defamatory, offensive, or illegal conduct of any third party and that the risk of harm or damage from the foregoing rests entirely with you.

 

To make use of the Website/App and Services for their intended purpose in a bona fide manner.

 

Germa Bazar is only an aggregator of service providers providing a platform for eligible and qualified Providers to connect with prospective customers. The Company shall not, in any manner whatsoever, be held liable or responsible for any matters in connection with the provision of the Service itself conducted either online or face to face at a location decided by mutual consent between the Provider and the Customers. The Company makes no representation or undertakes no responsibility with respect to any customers or the requirements of any customers.

 

Please remember that any provider of goods or services is entitled to register with germabazar.com. We do not examine whether the advertisers are good, reputable or quality sellers of goods/service providers. You must satisfy yourself about all relevant aspects prior to availing of the terms of service. Germa Bazar has also not negotiated or discussed any terms of engagement with any of the advertisers. The same should be done by you. Purchasing of goods or availing of services from advertisers shall be at your own risk.

 

We do not verify, investigate, represent or endorse the accuracy, legality of any products, services, other promotions, including ratings and recommendations contained on, business listing on our websites before or after including them in directory listings posted by our service providers on our Platform, and we make no representation and assume no responsibility concerning the content that third parties submit to become listed on our platform.

 

By uploading any content on the Platform, you also warrant that you own the copyright for that content. Any plagiarized content, once notified by the user or noticed by the company, will be liable to be removed from the Platform with or without any notice to you. For any liabilities arising out of your usage of plagiarised content, you shall be solely responsible and liable for the claims arising out of such legal proceedings.

 

If you are found guilty of sharing content that meets our above mentioned criteria, that will lead to immediate and permanent removal from the use of the Platform and the Services without any chance of suspension.

 

In addition to providing the Services as stated above, the Platform may also offer other information related to the Services either directly or indirectly using links to third-party websites. Any links to third-party websites that are provided on the Platform are for convenience and do not amount to the Company being responsible, in any manner, for such third party websites and their content. You may use such third party content at your own risk.

Regarding responses received from Germa Bazar Service site  

The Germa Bazar service site is a public site with free access and we assume no liability for the quality and genuineness of responses. Germa Bazar cannot monitor the responses that Service Provider / Service seeker may receive in response to information he/she has displayed on the site. The Service Provider / Service seeker would have to conduct its own background checks on the bonafide nature of all response(s).

 

OTP Acceptance:

 

By entering the one-time password (“OTP”) sent by GermaBazar, user is consenting his/her interest in availing the services of Germa Bazar.

User hereby agrees by action of submission of the OTP sent by Germa Bazar, constitutes a valid acceptance of the terms and conditions contained herein and which shall have binding effect on the user.
